These Terms & Conditions ("Terms") govern your use of the Serin platform as a job candidate ("Candidate," "you"). By creating an account, you agree to these Terms and to our Master Privacy & AI Policy and, where applicable, our Biometric Data Notice, each incorporated by reference.

1. What Serin Is

Serin AI ("Serin," "we") is a technology platform that hiring organizations ("Organizations") use to conduct AI-assisted interviews. Except where Serin acts as the hiring organization, Serin is not your employer or prospective employer, does not make hiring decisions, and is not a party to any employment relationship between you and an Organization. Use of Serin does not guarantee an interview, an offer, or any employment outcome.

2. Eligibility

You must be at least the minimum legal working age in your jurisdiction to create an account. You must provide accurate information during registration and keep your account credentials confidential. You are responsible for all activity under your account.

3. The Interview Process

3.1 What Happens During an Interview

When you participate in a Serin interview, the session involves: an AI system that conducts and/or assists in conducting the interview; recording of video, audio, and screen content as disclosed at account creation and re-confirmed immediately before each session; AI-based evaluation of your responses; and, where enabled, integrity/proctoring monitoring (mouse movement, eye-gaze patterns, behavioral signals).

You acknowledge and agree that your interview session is recorded and that the Organization to which you applied may view your recording through a view-only, time-limited, access-logged link. Serin does not provide Organizations with download access to recordings, and does not share your raw biometric data with any Organization under any circumstances.

3.3 AI Evaluation and Mandatory Human Review if Flagged

AI-generated scores, flags, and summaries are evaluation aids only. Serin requires Organizations using the platform to conduct human review before relying on AI-generated recommendations. Serin cannot independently verify or guarantee each Organization's compliance. While Serin recommends independent human review, the Organization is solely responsible for ensuring it occurs. Organizations are contractually required to perform human review before adverse decisions. Serin is not responsible if an Organization fails to comply. If an Organization fails to conduct this review and any compromise arises, the entire responsibility lies with the Organization. You may request an explanation of the factors that influenced your AI-generated assessment at any time (see Section 7).

3.4 Proctoring Flags Are Not Findings of Misconduct

An AI-detected proctoring flag (e.g., a window switch, a connectivity drop, an unusual gaze pattern) is a signal for human review, not a determination of wrongdoing. No candidate will be automatically disqualified, rejected, or penalized based on an unreviewed AI flag. Flags arising from disability-related behavior (involuntary movement, eye conditions, speech differences, assistive technology use) will not be treated as integrity concerns once an accommodation has been noted on your profile (Section 5).

4. Candidate Conduct

During an interview, you agree not to: use unauthorized materials or third-party assistance not permitted by the Organization's stated interview rules; impersonate another individual; attempt to manipulate, disable, or circumvent recording or proctoring systems; or otherwise misrepresent your identity or qualifications. A substantiated, human-reviewed violation of this section means the Organization may disqualify the candidate from that specific application; it will not result in restriction of your Serin account without separate notice and an opportunity to respond, except in cases of confirmed identity fraud.

5. Accommodations

If you require an accommodation - additional time, an alternative assessment format, a waiver of eye-tracking or webcam requirements due to a disability, sign-language interpretation, or a support person - request it via email at least 5 business days before your scheduled interview where feasible, or as soon as practicable otherwise. Requesting, or being granted, an accommodation will never be used to your disadvantage in scoring or evaluation, and is not visible to the Organization as part of your performance data without your separate consent.
To ensure your interview session is properly configured, you must request the accommodation directly from the hiring Organization and concurrently notify Serin at contact@serin-ai.com.

6. Alternative Evaluation and Live Interview Requests

If you wish to request a live, face-to-face interview, or an assessment conducted exclusively by a human reviewer, you must contact the hiring Organization directly. Serin does not coordinate, authorize, or administer these alternative evaluation arrangements; the responsibility for initiating and managing such requests rests entirely between you and the Organization. This option is available to all candidates, including those with disabilities.

7. Appeals and Review Rights

You may request the following from the Organization, subject to their internal policies:

Score review - a re-examination of your AI-generated score against the interview recording.
Proctoring flag appeal - a submission of context or explanation for a flagged event.
Explanation of AI assessment - a summary of the factors that contributed to your score.

Serin does not facilitate, review, approve, or coordinate these requests, nor do we manage the resulting appeal or review process. The hiring Organization is solely responsible for processing and responding to these matters. To initiate any such request, you must contact the Organization directly through their provided channels. These rights exist independently of, and in addition to, your data protection rights under the Master Privacy & AI Policy.

8. No Guarantee of Outcome

Serin makes no representation regarding the likelihood of any candidate receiving an interview, advancing in a hiring process, or receiving an offer. All such decisions are made solely by the Organization.

9. Intellectual Property

You retain ownership of the substantive content of your interview answers. By participating, you grant Serin a limited, non-exclusive license to record, process, store, and transmit that content solely for the purposes described in the Master Privacy & AI Policy (interview delivery, AI evaluation, and sharing with the relevant Organization). This license terminates upon deletion of the underlying data per our Data Retention Schedule, except where retention is required for legal or audit purposes as disclosed in that Policy. Serin retains ownership of AI-generated analyses, models, scores, metadata, derived features, transcripts, and reports.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS." SERIN DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, AND IS NOT RESPONSIBLE FOR HIRING DECISIONS, JOB OFFERS, OR EMPLOYMENT OUTCOMES, WHICH ARE MADE SOLELY BY THE ORGANIZATION. NOTHING IN THIS SECTION LIMITS ANY STATUTORY RIGHT THAT CANNOT LAWFULLY BE WAIVED, INCLUDING RIGHTS UNDER GDPR, BIPA, OR THE DPDP ACT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERIN’S AGGREGATE LIABILITY TO YOU ARISING OUT OF YOUR USE OF THE PLATFORM SHALL NOT EXCEED 5,000 INR. THIS LIMITATION SHALL NOT APPLY TO LIABILITY ARISING FROM (A) CLAIMS THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING STATUTORY DAMAGES UNDER DATA PROTECTION LAWS SUCH AS BIPA, GDPR, OR THE DPDP ACT, OR (B) INSTANCES OF GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. [Note: This liability cap is not intended for U.S. federal government agency customers. Liability for such engagements is subject to a separate Federal Addendum incorporating FAR-prescribed terms.]

12. Termination

You may close your account at any time. Mail at contact@serin-ai.com and our team will proceed with the deletion of your account data per our Retention Schedule, subject to data we are legally required to retain. We may suspend or terminate an account for confirmed fraud, identity misrepresentation, or violation of Section 4, with notice and an opportunity to respond except where immediate suspension is necessary to prevent harm.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, with the courts of Ahmedabad, Gujarat having exclusive jurisdiction, without regard to conflict-of-law principles. Nothing in this Section limits or overrides any mandatory consumer protection or data protection rights applicable under the laws of your country or jurisdiction of residence where such rights cannot be waived. Any disputes arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India. Where Serin services are provided in connection with a U.S. federal government agency customer, this Section does not apply; disputes are governed by applicable U.S. federal law and forum requirements instead.

14. Changes to These Terms

We will notify you by email or in-platform notice of material changes before they take effect. Continued use after the effective date constitutes acceptance of updated Terms, except where independent consent is legally required for a specific new use.

Sub-processors: A current list of sub-processors is maintained within internal Documents of Serin and updated with 5-day advance notice to Organizations before any new sub-processor is engaged. All sub-processors are bound by data processing agreements requiring security measures equivalent to our own and prohibiting independent use of the data. These Terms & Conditions ("Terms") govern access to and use of the Serin platform and related services (collectively, the "Platform" or "Services") by hiring organizations, their recruiters and administrators ("Organization," "Customer," "you"), and any other visitor to serin-ai.com who is not participating as a job candidate.

If you are a job candidate participating in an interview through Serin, your use of the Platform is governed by the separate Candidate Terms & Conditions, not by this page. Where any provision of these Terms conflicts with the Candidate Terms & Conditions as applied to a Candidate, the Candidate Terms & Conditions control.

By creating an Organization account, accessing the Platform, or otherwise using the Services, you agree to these Terms and to our Master Privacy & AI Policy and, where applicable, our Biometric Data Notice, each incorporated by reference.

1. Definitions

"Organization" means the company, agency, or other entity that has registered to use Serin to source, screen, or interview candidates, together with its Authorized Users.
"Authorized User" means an employee, contractor, or agent of the Organization who is permitted to access the Platform under the Organization's account (e.g., a recruiter or hiring manager).
"Candidate" means an individual who applies for or participates in an interview for a role posted or managed through the Platform.
"Credits" means the prepaid unit of access used to conduct interviews on the Platform, purchased under the plan(s) published at serin-ai.com/pricing as may be updated from time to time.
"Content" means job descriptions, evaluation criteria, company branding, and any other material an Organization submits to or configures within the Platform.
"Services" means, collectively, the Platform and all related features described in our Documentation, including including AI-assisted interview question generation, live AI interviewing, integrity/proctoring monitoring, scoring, and reporting.

2. Eligibility & Account Registration

You must be at least 18 years old and legally competent to enter into a binding contract to register for an Organization account. If you are registering on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms. You agree to provide accurate, current information during registration, to keep your account credentials confidential, and to be responsible for all activity that occurs under your account. You must notify us promptly at contact@serin-ai.com if you suspect unauthorized use of your account.

3. Description of Services

Serin provides a platform through which Organizations can: convert a job description into structured interview objectives; conduct AI-assisted or AI-led interviews with Candidates by video, audio, or text; apply integrity/proctoring monitoring during interviews (as described in our Master Privacy & AI Policy and Biometric Data Notice); receive AI-generated scoring, summaries, and reports; and manage applications through to a hiring decision. Serin is a technology provider to the Organization. Serin is not a party to, and assumes no responsibility for, the employment relationship (if any) between the Organization and a Candidate.

4. Credits, Billing & Refunds

4.1 Purchase and consumption. Access to interviews is provided through Credits, purchased under the plan(s) published on our pricing page at the time of purchase. Credits are consumed based on completed interview length, as described in our Documentation.

4.2 Non-expiry, subject to change. Credits do not expire under current plan terms. We may change this policy for future purchases with reasonable prior notice; any change will not apply retroactively to Credits already purchased.

4.3 Payment processing. Payments are processed by our payment sub-processor (see Privacy & AI Policy, Section 6.2). You authorize us and our payment processor to charge your selected payment method for all fees incurred.

4.4 Taxes. Fees are exclusive of applicable taxes (including GST), which you are responsible for unless you provide a valid exemption certificate.

4.5 Refunds. Except where required by applicable law, purchased Credits are non-refundable once issued to your account. If you believe you were charged in error, contact contact@serin-ai.com and we will review the request in good faith.

4.6 Promotional pricing. Discounts, promotional codes, or free-tier Credits (e.g., our Explorer plan) may be modified or withdrawn at our discretion for future purchases, without affecting Credits already issued to your account.

4.7 Price changes. We may update plan pricing at any time; changes will not affect Credits already purchased and will apply only to future purchases, with the then-current pricing published at serin-ai.com/pricing.

5. Organization Responsibilities

As a condition of using the Services, you agree that:

5.1 Human review. You will ensure that a qualified human reviewer evaluates all AI-generated scores, flags, and recommendations before any hiring decision is communicated to a Candidate. No adverse decision may be based solely on unreviewed AI output. Serin recommends this as a mandatory best practice and requires it contractually; Serin cannot independently verify your compliance, and responsibility for a failure to conduct human review rests solely with you.

5.2 No re-sharing or downloading of Candidate data. You will not download, screen-record, store outside the Platform, re-share, or use interview recordings, transcripts, or reports for any purpose beyond the specific hiring decision for which the Candidate applied. Raw biometric data, biometric templates, and eye-tracking data are never made available to you, and you will not attempt to obtain or reconstruct such data.

5.3 Lawful, accurate job postings. Any job description, evaluation criteria, or Content you submit must be accurate, lawful, and non-discriminatory, and you are solely responsible for ensuring your hiring criteria and process comply with applicable employment, labor, and anti-discrimination law in every jurisdiction in which you hire.

5.4 Accommodations. You will cooperate with Candidate accommodation requests as described in the Candidate Terms & Conditions, including waiving eye-tracking or webcam requirements where appropriate and not treating a disability-related proctoring flag as a finding of misconduct.

5.5 Compliance with data protection law. You are responsible for having a lawful basis to process Candidate personal data for your own hiring purposes, in addition to the consent Serin obtains from Candidates for platform-level processing described in our Privacy & AI Policy.

6. Acceptable Use

You will not, and will not permit any Authorized User or third party to: reverse-engineer, decompile, or attempt to extract the source code or underlying models of the Platform; scrape, crawl, or systematically extract data from the Platform; resell, sublicense, or provide access to the Services to any third party without our prior written consent; use the Services to build a competing product; introduce malware or attempt to circumvent security, rate-limiting, or integrity/proctoring systems; or use the Services in violation of any applicable law, including export control and anti-corruption laws.

7. Intellectual Property

7.1 Serin's IP. Serin retains all right, title, and interest in and to the Platform, our AI models and algorithms, our Documentation, and all AI-generated analyses, scores, models, transcripts, metadata, derived features, and reports produced through the Services. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services and to use AI-generated reports solely for your own internal hiring purposes.

7.2 Your Content. You retain ownership of the Content you submit (job descriptions, company branding, evaluation criteria). You grant Serin a limited license to use that Content solely to provide, operate, and improve the Services for you, and - only in anonymized, aggregated form as described in our Privacy & AI Policy, Section 4.1 - to improve our AI models generally. We will not use your Content to benefit a different Organization's hiring process.

8. Data Protection

Our collection, use, and disclosure of personal data in connection with the Services is described in the Master Privacy & AI Policy and, for biometric data, the Biometric Data Notice, each of which is incorporated into these Terms by reference. For Organizations operating under a signed Organization Master Agreement or Data Processing Agreement, the terms of that agreement govern the allocation of controller/processor responsibilities and prevail over this Section in the event of a conflict.

9. Confidentiality

Each party will protect the other's non-public business, technical, and pricing information disclosed in connection with the Services with the same degree of care it uses for its own confidential information (and no less than a reasonable degree of care), and will use such information solely to perform its obligations under these Terms. This obligation does not apply to information that is or becomes publicly available through no fault of the receiving party, or that is independently developed without reference to the disclosing party's confidential information.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." SERIN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED SCORES OR RECOMMENDATIONS WILL BE ACCURATE OR SUITABLE FOR ANY PARTICULAR HIRING DECISION. SERIN DOES NOT PROVIDE LEGAL, EMPLOYMENT, OR COMPLIANCE ADVICE, AND HAS NOT ADVISED YOU ON YOUR OWN COMPLIANCE WITH EMPLOYMENT, ANTI-DISCRIMINATION, OR DATA PROTECTION LAW. ALL HIRING DECISIONS ARE MADE SOLELY BY YOU, AND YOU BEAR SOLE RESPONSIBILITY FOR THOSE DECISIONS AND FOR ANY FAILURE TO CONDUCT THE HUMAN REVIEW REQUIRED UNDER SECTION 5.1. NOTHING IN THIS SECTION LIMITS ANY STATUTORY RIGHT THAT CANNOT LAWFULLY BE WAIVED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH PARTY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY THE ORGANIZATION TO SERIN IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM [amount to be confirmed with counsel and, where applicable, aligned with any signed Organization Master Agreement]. NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS LIMITATION DOES NOT APPLY TO: (A) CLAIMS THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING STATUTORY DAMAGES UNDER DATA PROTECTION LAWS; (B) A PARTY'S INDEMNIFICATION OBLIGATIONS UNDER SECTION 12; OR (C) GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. Where Serin services are provided to a U.S. federal government agency customer, liability is instead governed by a separate Federal Addendum incorporating FAR-prescribed terms.

12. Indemnification

You agree to indemnify and hold Serin harmless from any third-party claim, loss, or liability arising from: (a) your job postings or Content; (b) your hiring decisions or your failure to conduct the human review required under Section 5.1; (c) your violation of applicable employment, anti-discrimination, or data protection law; or (d) your breach of these Terms.

13. Term, Suspension & Termination

You may close your Organization account at any time by contacting contact@serin-ai.com. We may suspend or terminate your account for a material breach of these Terms, non-payment, or conduct that risks harm to Candidates, other users, or the Platform, with notice and an opportunity to cure where reasonably practicable, except where immediate suspension is necessary to prevent harm. Upon termination, your right to access the Services ends; any unused Credits are handled per our then-current Credits policy (Section 4), and data is retained or deleted per the schedule in our Privacy & AI Policy, subject to data we are legally required to retain. Sections 7, 9, 10, 11, 12, and 15 survive termination.

14. General Website Use

If you are visiting serin-ai.com without an Organization account or Candidate interview session (for example, browsing our site, reading our Documentation, or submitting a contact form), you agree to use the website only for lawful purposes and not to interfere with its operation, scrape its content, or misuse any contact or support channel. All trademarks, logos, and site content not otherwise licensed to you remain the property of Serin AI or its licensors. Our website may link to third-party sites; we are not responsible for the content or practices of any site we do not operate.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, with the courts of Ahmedabad, Gujarat having exclusive jurisdiction, without regard to conflict-of-law principles. Nothing in this Section limits or overrides any mandatory consumer protection or data protection rights applicable under the laws of your country or jurisdiction of residence where such rights cannot be waived. 16. Relationship to Other Serin Policies

These Terms incorporate by reference, and should be read together with:

Master Privacy & AI Policy - how we collect, use, and protect personal data.
Biometric Data Notice - how we collect, use, and protect biometric data specifically.
Candidate Terms & Conditions - the terms governing a Candidate's participation in an interview.

Where these Terms are silent on a matter addressed in one of the above, the more specific policy controls.

17. Changes to These Terms

We may update these Terms from time to time. We will post the effective date of any change at the top of this page and, for material changes, notify Organization account owners by email or in-platform notice before the change takes effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
